This Privacy Policy explains how Sky Enterprises Australia ("we", "us", "our") collects, uses, stores, and discloses personal information when you use our services ("Service"). It is intended to comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
By using the Service, you acknowledge you have read and understood this policy.
1. About this policy
Sky Enterprises Australia Pty Ltd (ABN 36 679 004 767) ("Sky Enterprises", "we", "us" or "our") is an Australian company based in South Australia.
This Privacy Policy explains how we handle personal information when you visit skyenterprisesau.com and its company or product-information pages (the "Website"), contact Sky Enterprises directly, or otherwise interact with Sky Enterprises in a general company capacity.
This policy is intended to reflect the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles where they apply to us. It also describes additional rights that may apply under privacy laws in other countries.
The Website is a static company and product-information website. It does not provide user accounts, payments, subscriptions, uploads, public profiles, APIs, artificial-intelligence features or social login.
2. Product-specific privacy notices
Sky Enterprises products operate separately and maintain separate databases. This policy does not replace the privacy notice for an individual product. The applicable product notice explains the product's accounts, content, payments, uploads, integrations and other product-specific processing.
If a product-specific notice and this policy both apply, the product-specific notice governs the handling that is unique to that product. This policy continues to apply to general Website and company interactions. We do not combine or share personal information between separate product databases unless a product notice expressly says otherwise or disclosure is required by law.
3. Personal information we collect
3.1 Website and analytics information
When you visit the Website, we and our service providers may automatically collect:
- IP address and approximate location derived from it;
- browser, operating system and device information;
- pages viewed, referring page, links selected and interaction events;
- visit time, session duration and general usage patterns;
- cookie or similar identifier information; and
- security, performance and diagnostic information.
We do not use the Website to collect payment information, account credentials, uploaded files or sensitive information.
3.2 Communications
If you email us, we may collect your name, email address, organisation, the content of your message, attachments and any other information you choose to provide. Email is handled through Zoho.
Please do not send sensitive personal information unless it is reasonably necessary for us to deal with your request.
3.3 Information from other sources
We may receive limited technical or referral information from our hosting, analytics, content-delivery and security providers. If you follow a link to or from a product or third-party website, that site may separately collect information under its own privacy notice.
4. How we use personal information
We use personal information to:
- operate, secure and deliver the Website;
- understand Website traffic and improve content, design and performance;
- detect malicious traffic, abuse, outages and security incidents;
- respond to enquiries, complaints and privacy requests;
- maintain business, legal and security records;
- establish, exercise or defend legal claims; and
- comply with applicable laws and lawful government requests.
We do not use the Website to send newsletters or promotional email, and we do not sell or rent personal information.
Where the GDPR or UK GDPR applies, our legal bases are legitimate interests for Website security, basic operations, service improvement and ordinary business enquiries; consent for non-essential analytics cookies where legally required; and legal obligation where processing is necessary to comply with law.
You may object to processing based on legitimate interests. Where processing is based on consent, you may withdraw that consent at any time without affecting earlier lawful processing.
5. Cookies and analytics
Cookies are small data files stored on or accessed from your device. Similar technologies can perform comparable functions.
- Essential or technical storage: Used for hosting, security, content delivery and remembering your privacy choice.
- DataFast analytics: Helps us understand visits and Website interactions. DataFast may use cookies or similar identifiers and may process IP addresses, device data and activity information.
- Hostinger technologies: Used in connection with static Website hosting.
- Cloudflare technologies: Used for content delivery, resilience and security. Cloudflare may process network and device information when delivering or protecting the Website.
Non-essential analytics are activated only after consent where applicable law requires prior consent. You can accept or reject analytics through the Website's cookie control and later reopen Cookie settings in the footer. You can also block or delete cookies using your browser, although browser controls may not remove information already processed.
The storage used to remember your selection is necessary to honour that selection and does not enable analytics by itself.
6. Disclosure to service providers and others
We may disclose limited personal information to providers that support our Website and business operations:
- Hostinger — static Website hosting;
- DataFast — Website analytics;
- Cloudflare — content delivery, network performance and security; and
- Zoho — business email and correspondence.
These providers process information under their own terms and privacy commitments. We may also disclose information where required or authorised by law; to investigate abuse or security incidents; to protect legal rights or safety; to professional advisers under confidentiality obligations; or in connection with a genuine corporate transaction subject to appropriate safeguards.
We do not sell personal information or share it for cross-context behavioural advertising.
7. Overseas processing
Sky Enterprises is based in Australia, but our providers may process information in other countries. Hostinger and DataFast may process Website data in the United States. Cloudflare and Zoho may process information in countries where they or their subprocessors operate.
Privacy protections in those countries may differ from Australian law. Where required, we will take reasonable steps to ensure overseas recipients handle personal information appropriately. Where the GDPR or UK GDPR applies, we will rely on an available lawful transfer mechanism, such as an adequacy decision or approved standard contractual clauses.
8. Retention and deletion
We keep personal information only for as long as reasonably needed for the purposes described in this policy, including legal, security and record-keeping requirements.
- Analytics information may be retained for up to five years.
- Ordinary enquiries and correspondence are generally retained for up to five years after the last interaction, unless reasonably required longer for an ongoing matter or by law.
- Security and server records are retained according to Hostinger and Cloudflare settings and deleted or de-identified when no longer reasonably required.
- Cookie-consent preferences remain on your device until they expire or you clear them.
We may retain de-identified or aggregated information where it can no longer reasonably identify you.
9. Security and data breaches
We use reasonable technical and organisational measures appropriate to the limited information handled through the Website. These may include access controls, encrypted transmission, restricted administrative access, security monitoring and reputable hosting and network providers.
No online system is completely secure. If we become aware of a suspected data breach, we will investigate and assess it. Where the Australian Notifiable Data Breaches scheme or another applicable law requires notification, we will notify affected individuals and the relevant regulator within the required timeframe.
10. Your privacy rights
Depending on where you live and which law applies, you may have the right to:
- request access to personal information we hold about you;
- request correction of inaccurate or incomplete information;
- request deletion or erasure, subject to lawful exceptions;
- restrict or object to particular processing;
- withdraw consent where processing relies on consent;
- request a portable copy of eligible information;
- complain about our handling of personal information; and
- receive equal service and treatment when exercising a privacy right.
To make a request, contact [email protected]. We may need to verify your identity before responding. We aim to respond within 30 days for Australian, EEA and UK requests and within 45 days for eligible California requests, subject to lawful extensions.
Australian complaints
If you are in Australia and have a privacy complaint, contact us first at [email protected]. We will investigate and aim to respond within 30 days. If you are not satisfied, you may contact the Office of the Australian Information Commissioner.
EEA and UK rights
If the GDPR or UK GDPR applies, you may lodge a complaint with the data-protection authority where you live or work. Sky Enterprises has not appointed a Data Protection Officer. Our privacy contact is [email protected].
California disclosures
In the preceding 12 months, the Website may have collected identifiers, internet or network activity, and correspondence from the sources described in section 3. We use and disclose these categories for the purposes and to the provider categories described above. We do not sell personal information, share it for cross-context behavioural advertising or use sensitive personal information to infer characteristics.
11. Children
The Website is a general-audience company website and is not directed to children under 13. We do not knowingly collect personal information from children under 13 through the Website. If you believe a child has provided personal information to us, contact [email protected] and we will take reasonable steps to investigate and delete it where appropriate.
Individual products may have different age requirements, which are explained in their product-specific documents.
12. Automated decision-making
The Website does not use personal information to make automated decisions that produce legal or similarly significant effects about individuals.
13. Third-party links
The Website links to product sites, app stores, social networks and other third-party services. We are not responsible for the privacy practices of websites or services we do not control. Review their privacy notices before providing information.
14. Changes to this policy
We may update this policy when our Website, providers or legal obligations change. The updated policy will be posted at this URL with a revised Last updated date. Because the Website does not maintain visitor accounts or a mailing list, policy changes will ordinarily be announced on the Website only.
15. Contact
For privacy questions, complaints, rights requests or general legal enquiries, contact [email protected].
